Understanding Foreclosure When you do Real Estate Investing
The business of real estate investing requires that you have an understanding of the legalities of foreclosures. As is the case with most aspects of the law, the law as it pertains to foreclosures differs from state to state. That said, there is a standard procedure that must take place in order for foreclosure to take place.
The foreclosure process is quite lengthy before it gets to the stage of being sold at the sheriff’s office. This is of interest to those people who are into real estate investing as many bargains can be picked up in this way. Foreclosure comes about as a result of homeowners not making their monthly payments on the mortgage to the bank. Before issuing finance to borrowers, the banks do apply pretty stringent criteria before people can qualify for finance to purchase a home.
Once the borrower has satisfied the bank that he or she is able to make the repayments, the bank will issue the finance for the home. Money is lent to the borrower at interest. Interest allows the banks to make a profit on the money that they lend to borrowers.
If for any reason, the borrower is unable to make the monthly payments, the banks have the right to foreclosure and take over ownership of the property. Banks usually wait for 90-180 days before beginning the process of foreclosure. Banks would rather that the money is paid than take back the home as they are in the business of lending money not owning houses or properties.
Banks find the process of foreclosure rather cumbersome and there are costs incurred with this process that the they can end up being responsible for. The process of foreclosure beings by the banks filing a Notice of Default at the County Recorders Office. In this way the homeowners and the county are notified that foreclosure has begun. A trustee has to take all the necessary steps to ensure that the homeowners are aware that foreclosure has been initiated.
